Mediation is a confidential, voluntary and interactive process in which a neutral-third party facilitates productive discussions between disputing parties to help them reach a mutually acceptable resolution. Unlike litigation, mediation emphasizes collaboration over confrontation, and often results in faster, more cost-effective outcomes.
The mediator’s role is to seek, but not impose or compel, a resolution of the dispute that all parties can accept. The mediation process may be required by certain courts or administrative agencies, or by the terms of the parties’ contract; but it can also be entirely voluntary. Mediation can be highly effective at any point before or during formal litigation.
Why Mediation?
Legal disputes can be stressful, and navigating them efficiently and cost-effectively is vital. While litigation provides a structured avenue for dispute resolution, it is often expensive, protracted, and physically and emotionally draining.
Mediation is a flexible process that can be tailored to suit the complexity of the dispute and the specific needs of the parties. The formal structure and requirements of a court proceeding are not present with mediation; nor are the limitations on potential remedies. The parties can avoid the disclosure of confidential information, and are not required to provide testimony under oath. A mediator is not bound by evidentiary or statutory constructs; and can frequently aid the parties in finding creative or non-economic alternatives to typical legal remedies.
Mediation is a confidential process, which allows the parties to avoid unfavorable or embarrassing public filings. It affords the parties an often-cathartic opportunity to air grievances and discuss their perspective on the dispute in an informal and more relaxed environment than a courtroom. This candid and more relaxed environment often fosters honest and open settlement efforts.
Throughout the mediation process, the parties retain control over any potential outcome. A settlement is only reached when all parties consent. Thus, the result is in the parties’ hands, rather than imposed upon them under the law and by a judge or jury. This results in a collaborative and less adversarial process.
Successful mediations afford all parties with finality and closure. The settlement terms are often confidential, alleviating the parties’ concerns about adverse publicity associated with the results.
